Declaration of a constitutional
Supreme Council of the Armed Forces
After perusal of the Constitutional Declaration issued on 13 February.
And the results of the referendum on amending the Constitution of the Arab Republic of Egypt, which took place on 19 of the
March, 2011 and announced the result of the approval on 20 March 2011.
And the statement issued by the Supreme Council of the Armed Forces on 23 March 2011
RESOLVED:
Article 1
Arab Republic of Egypt is a democratic state based on citizenship. And the Egyptian people are part of the Arab nation and works to achieve comprehensive unity.
Article 2
Islam the state religion and Arabic the official language, and the principles of Islamic Sharia the main source of legislation.
Article 3
Sovereignty of the people alone, the source of authority is exercised by the people and protect this sovereignty and safeguard national unity.
Article 4
Citizens have the right of association and the establishment of trade unions, associations and parties in the manner prescribed by the law.
And prohibits the establishment of societies whose activities are hostile to the social system, clandestine or have a military character. May not be engaging in any political activity or the establishment of political parties based on religion or based on discrimination because of sex or origin.
Article 5
The economy in the Arab Republic of Egypt on the development of economic activity, social justice and ensure that the various forms of ownership and the preservation of the rights of workers.
Article 6
Public ownership is sacrosanct, and protect and support the duty of every citizen in accordance with the law.
And private property is inviolable and may not be placed under sequestration except in cases defined by law and by virtue of a judicial, not be expropriated except for public interest and in return for compensation in accordance with the law. The right of inheritance shall be guaranteed.
Article 7
Citizens are equal before the law, they are equal in rights and duties without discrimination on grounds of sex, origin, language, religion or creed.
Article 8
Personal freedom is natural right and shall not affect, and except in the case of flagrante delicto, no one may be arrested, searched, detained or his freedom restricted or prevented from free movement except by an order necessitated by investigations and preservation of public security, and issue this command from the competent judge or public prosecutor, in accordance with the provisions of the law. Article 9
Every citizen is arrested or detained or whose freedom is restricted in any way be treated in a manner that preserves his dignity as a human, shall not be harmed physically or morally, and may not be detained or imprisoned in places that are subject to the laws regulating prisons. Article 10
Homes are inviolable and may not be entered or inspected except by a causal judicial warrant and in accordance with the provisions of the law.
Article 11
The inviolability of the private lives of citizens protected by law. Correspondence, wires, telephone calls and other means of communication privacy, and confidentiality is guaranteed, may not be confiscated or found or monitored except by a causal judicial warrant and for a specific and in accordance with the provisions of the law.
Article 12
The State shall guarantee freedom of belief and freedom to practice religious rites. And freedom of opinion guaranteed, and every person to express and propagate his opinion verbally, in Ketabpoo photography or other means of expression within the limits of the law, and self-criticism and constructive criticism to ensure the safety of national construction.
Article 13
Freedom of the press, printing, publication and mass media shall be guaranteed, and censorship on newspapers is forbidden, and warning, suspension or cancellation by administrative methods, and may be an exception in case of emergency or in time of war, imposed on the newspapers and publications and the media controlled specific in matters related to public safety or national security purposes , all in accordance with the law.
Article 14
Shall not prohibit any citizen to reside in a specific destination, or be compelled to stay at a particular place except in the cases prescribed by law.
Article 15
Does not any citizen may be deported from the country or prevented from returning to it, and extradition of political refugees is prohibited.
Article 16
Citizens have the right at the Special Meeting of peaceful and unarmed and without the need for prior notice. May not be for the security men attend such private meetings, and public meetings, processions and gatherings shall be permitted within the limits of the law.
Article 17
Any assault on personal liberty or the sanctity of private life of citizens and other public rights and freedoms guaranteed by the Constitution and the law do not fall offense of criminal proceedings and civil statute of limitations arising therefrom, and the state guarantees fair compensation to the victim of such assault.
Article 18
Create a public tax, modified or not be canceled except by law. Shall not be relieved of a performance, except in cases defined by law. May not be assigned a performance of the other taxes or fees except in the limits of the law.
Article 19
Punishment is personal.
No crime or punishment except under the law, shall be imposed only by a judicial decision, not punishment
Only to acts committed subsequent to the effective date of the law.
Article 20
The accused is innocent until proven guilty in a court of law that guarantees the right to defend himself, and all the accused in the crime must have a lawyer to defend him.
Article 21
Litigation is a right protected and guaranteed to all people, and every citizen has the right to resort to the courts, the State guarantees that the elimination of the litigants and settle cases promptly. Any provision in the laws protecting any administrative action or decision from judicial review.
Article 22
The right to defend in person or by proxy is guaranteed. The law guarantees to those without the financial means to resort to the courts to defend their rights.
Article 23
Inform each person who is arrested or detained on grounds of his arrest or detention immediately, and shall have the right to communicate, to inform him what had happened or the use of tags on the face which is organized by law, must be declared promptly of the charges against him, with two other appeal before the court of the procedure, which is personal liberty, and law regulates the right of recourse to ensure that a determination within a specified period, failing which he must inevitably release.
Article 24
Judgments are issued and executed in the name of the people, and have to refrain from or delay its implementation by concerned public officials a crime punishable by law. The Plaintiff in this case has a right to bring a criminal action directly to the competent court.
Article 25
Head of State is the President of the Republic, and shall assert the sovereignty of the people and to respect the Constitution and the rule of law and protect national unity and social justice in the manner set forth in this Declaration and the law. And will start immediately after taking office the terms of reference provided for in Article 56 of this Declaration other than set out in items 1 and 2 .
Article 26
Whoever is elected President of the Republic must be an Egyptian born to Egyptian parents and enjoy his civil and political rights, and should not have to carry or any of the parents nationality of another State, and not be married to a non-Egyptian, and not under the age of forty years of age.
Article 27
The President is elected by direct secret ballot.
Required to accept the nomination for the Presidency of the Republic to support the advanced nominate Thirty members at least of the members elected to the People's Assembly or the Shura, or that the candidate receives the support of at least thirty thousand citizens who have the right to vote in the five years the province at least, so that at least the number of supporters in any of those provinces for a thousand supporters.

Each political party which won a seat on its members by universal suffrage, at least in any of the People's Assembly and Shura Council in the last elections to nominate one of its members for the presidency.
Article 28
Committee is responsible for high judicial called "Presidential Elections Committee" to supervise the elections of the President of the Republic from the announcement of the nominations are open until the announcement of the election result.
The Committee of the President of the Supreme Constitutional Court as Chairman, and the membership of the President of the Cairo Court of Appeal, and the senior deputy head of the Supreme Constitutional Court, and Senior Vice President of the Court of Cassation, the senior deputy head of the State Council.
The decisions of the Committee are final and binding in itself, can not be challenged by any means or before any authority, nor may its exposure to a stay of execution or cancellation, as decided by the Commission in its jurisdiction, and other law defines the terms of reference of the Committee.

And issue the Supreme Constitutional Court decision in this matter within fifteen days from the date of submission thereto, if the Court decides not to constitutional text or more must be the realization of the appropriate resolution at the passage of the law, and in all cases, the court's decision is binding on all parties and all authorities of the State, and published in the Official Gazette within three days from the date of issuance.
Article 29
The presidential term of four years beginning from the date of the election result, may not be re-elected President of the Republic for only one consecutive term.
Article 30
Council President to lead the people before they start his duties the following oath:
"I swear by Almighty God to uphold the Republican system, to respect the Constitution and the law, and safeguard the interests of the people fully and to safeguard the independence and territorial integrity."
Article 31
Appointed by the President, within sixty days from the Mbacherth office, his deputy or more sets of reference, if the circumstances warrant his removal from office shall be to appoint someone else. Article 32
The board of people from a number of members determined by law, not less than three hundred and fifty members, at least half of the workers and peasants, and shall be elected through direct election of the secret of the year. Article 33
The People's Assembly election as soon as the legislative authority, and decides the general policy of the state, the general plan of economic and social development, and the general budget of the State, and exercises control over the work of the executive branch.
Article 34
The term of the people of five calendar years from the date of its first meeting.
Article 35
A Shura Council of a number of members determined by law but not less than one hundred and thirty-two members, elected by two thirds of the members of the Council elected by direct secret public to be at least half of the workers and peasants, and the president appoints the other third. The law determines the electoral constituencies of the Shoura Council.
Article 36
For membership of the Council for six years.
Article 37

1 Draft general plan for social and economic development.

Article 38
The law regulates the right of candidacy to the People's Assembly and Shura Council in accordance with any electoral system may determine. May include a minimum participation of women in the two chambers.
Article 39
The law defines the conditions to be met in members of the People's Assembly and Shura Council, and shows the provisions of the election and the referendum. The Committee on Graduate of the formation of a full judicial supervision of elections and referendums, ranging from the registration tables of election and until the announcement of the result, all as regulated by law. And hold the voting and counting under the supervision of members of judicial bodies nominated by the Supreme councils, and issue selected by a decision of the Supreme Committee.
Article 40

Article 41

Article 42
Divides every member of the People's Assembly and Shura Council before his council before they start work the following oath:
"I swear by Almighty God to uphold the integrity of the nation and the republican system, and safeguard the interests of the people, to respect the Constitution and law."
Article 43
May not be for each member of the People's Assembly and Shura Council during his term of office, purchase or rent any State property, or lease or sell something of his money or bartered it, or enter into a contract with the State as entrepreneur, importer or contractor.
Article 44
Not permissible to abort a membership of members of the People's Assembly and Shura Council only if the confidence and esteem, or loss of one of the conditions for membership status or the worker or peasant, which was elected on the basis of, or in breach of the duties of membership. And must be dropping the membership of the Council two-thirds majority of its members.
Article 45
Is not permissible in the case of flagrante delicto, to take any criminal proceedings against one of the members of the People's Assembly and Shura Council unless prior permission from its board. Article 46
The judiciary is independent, and by courts of different types and grades, and issue judgments in accordance with the law.
Article 47
Judges are independent, and can not be dismissed and the law shall regulate the disciplinary actions against them, subject to no authority except that of the law, is not permissible for any authority to interfere in issues or in the affairs of justice.
Article 48
The State Council, an independent judiciary, and respect to adjudicate in administrative disputes and in disciplinary actions, the law defines the terms of reference of the other.
Article 49
Supreme Constitutional Court, a judicial body independent and autonomous, and shall, without other oversight jurisdiction over the constitutionality of laws and regulations, and the interpretation of legislative texts, and in the manner prescribed by the law. The law specifies other powers of the court, and regulate the procedures to be followed before it.
Article 50
Law defines the jurisdictions and functions, and the method of formation, and prescribe the conditions and procedures for the appointment of its members and transporting.
Article 51
The law shall regulate military judiciary and shows the terms of reference within the limits of constitutional principles.
Article 52
Court hearings are public unless the court decides to make them secret interest of public order or morals,
In all cases, the verdict in open court.
Article 53
Armed forces belong to the people charged with protecting the country's territorial integrity and security, nor shall any body or group may establish military or paramilitary formations, military and homeland defense, land and sacred duty, and conscription is compulsory, and in accordance with the law.
The law specifies the conditions of service and promotion in the armed forces.
Article 54
Council shall be called the "Council of National Defense" and shall be chaired by President of the Republic, and specializes in private affairs in view of the means of securing the country and safety, and its terms of reference of other law shows.
Article 55
The police is a civil order, performed its duty in serving the people, and ensure that citizens trust and security, providing for the maintenance of order and public security and morality in accordance with the law.
Article 56
The Supreme Council of the armed forces manage the affairs of the country, and in order to immediately have the following powers:
1 legislation.
2 Adoption of the policy of the state and the public budget and monitor its implementation.
3 Appointment of members appointed by the Council of the people.
4 to invite the People's Assembly and Shura Council to hold its regular session, resolution and call for an extraordinary meeting and silver.
5 Right to promulgate laws or object to them.
6 represent the State at home and abroad, and the conclusion of international treaties and conventions, and are considered part of the legal system in the country.
7 Set the Prime Minister and his deputies, ministers and their deputies and relieve them from their posts.
8 Appointment of civil servants and military and political representatives and isolation in the manner prescribed in the law, and the adoption of the representatives of foreign states.
9 to pardon or commute a sentence The amnesty shall not be granted except by law.

The Council may delegate its Chairman or one of its members in any of the terms of reference.
Article 57
The Council of Ministers and the Ministers the executive branch, each in his own jurisdiction, and the Council in particular the following duties:
A subscription with the Supreme Council of the armed forces in the development policy of the State, and supervise their implementation in accordance with the laws and resolutions of the Republic.
2 guidance, coordination and follow-up work of the ministries and their affiliated bodies and public institutions.
Version 3 administrative and executive decisions in accordance with the laws and regulations, decisions and monitor their implementation.
4 Preparation of draft laws, regulations and decisions.
5 Preparation of the draft general budget of the state.
6 issues a draft general plan of the State.

8 Note the implementation of the law, maintaining State security and protecting the rights of citizens and the interests of the state.
Article 58
The Minister shall not, took office during that carries a liberal profession or a business, financial or industrial, or to purchase or rent any State property, or lease or sell something of his money, or industrial activity.
Article 59
Announced by the President of the Republic, after consulting the Council of Ministers, the state of emergency in the manner prescribed by law and this Declaration must be presented to the Council of the People during the seven days following the decision upon it.

Article 61
Continue to the Supreme Council of the armed forces in direct terms of reference set out in this Declaration so as to when he took all of the People's Assembly and Shura Council to their terms of reference, and even the presidential election and conduct of all his duties in a timely manner.
Article 62
All provisions of laws and regulations prior to the issuance of the provisions of this constitutional proclamation shall remain valid and enforceable, however, may be repealed or amended in accordance with the rules and procedures established in this Declaration.
Article 63
This announcement is published in the Official Gazette and shall take effect from the day following the date of publication.

Article 38

Article 42

Article 43

Article 48

Article 57
The Council of Ministers and the Ministers the executive branch, each in his own jurisdiction, and the Council in particular the following duties:

Article 58
